§ 1 Scope and Contracting Parties

1.1 These General Terms and Conditions (GTC) apply to all orders placed via our online shop www.solomias.de (Website).

1.3 By placing an order, the customer confirms that they have read and agree to these Terms and Conditions. These Terms and Conditions are a legally binding document that governs the rights and obligations of both parties.

Section 2 Processing of personal data

2.1 Personal data is processed in accordance with our privacy policy. We recommend that customers read it carefully.

2.2 The customer's personal data will be used to identify the customer, process and deliver the order, create invoices, make refunds and fulfill other contractual obligations.

§ 3 Products and product description

3.1 The products (bags) displayed on the website are presented using images and descriptions. We strive for accurate representation, but cannot guarantee that the colors on the customer's screen will exactly match the actual products. The customer understands that slight variations are possible.

3.2 Product images may show accessories that are not included in the delivery. The items included in the product package are listed in the product description.

3.3 All products are sourced from Italy. For products marked "Pre-order", the bag is ordered specifically for the customer in Italy.

§ 4 Prices and shipping costs

4.1 All prices are final prices in euros and include the statutory value added tax of 19%.

4.2 In addition to the prices shown, we charge shipping costs of €5.99 for deliveries within Germany. Orders over €150 qualify for free shipping.

4.3 The shipping costs are displayed in the order form before the order is completed.

4.4 If a price is incorrectly stated due to a technical error, we will inform the customer immediately by email and agree on a solution that is advantageous for the customer.

§ 5 Conclusion of contract and ordering

5.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

5.2 By clicking the "Place order" button, the customer submits a binding order. The customer thereby confirms that they have familiarized themselves with the product description, the delivery date, and these terms and conditions.

5.3 The purchase contract is concluded when we accept the order by sending an order confirmation via e-mail.

5.4 The customer is obliged to provide accurate and complete information (name, delivery address, email, telephone number). The customer is responsible for any errors or inaccuracies in the information provided.

5.5 If an ordered product is no longer available, we will inform the customer immediately by email or SMS to arrange a solution.

§ 6 Payment Terms

6.1 Payment is made via the payment methods provided by Shopify (e.g., credit card, PayPal, instant bank transfer). The available payment methods are displayed during the checkout process.

6.2 The customer undertakes to pay the purchase price and shipping costs at the time of ordering.

§ 7 Delivery and delivery times

7.1 Delivery within Germany will be made to the delivery address specified by the customer.

7.2 Delivery times:

a) Products in stock: Usually 2-4 working days after receipt of payment

b) Pre-order: 2-3 weeks after receipt of payment, as these bags are specially ordered for the customer from Italy.

7.3 The respective availability and expected delivery time are clearly indicated for each product and are also visible in the shopping cart.

7.4 After the order has been shipped, the customer will receive a shipping confirmation with tracking number via email.

7.5 Delays: We cannot influence delivery delays caused by the manufacturer in Italy, transport companies, weather conditions, customs clearance, or other circumstances beyond our control. Should a delay occur, we will inform the customer immediately by email.

7.6 If delivery cannot be made because the customer is not present at the specified address, a second delivery attempt will be arranged. Additional costs may apply for a second delivery attempt, according to the shipping provider's price list.

7.7 If the customer does not collect the order within the period specified by the shipping service provider, additional costs may be incurred for redelivery.

7.8 We are not responsible for incorrect or inaccurate delivery information provided by the customer. This may result in the order being delivered to a different person.

§ 8 Retention of Title

The delivered goods remain our property until full payment has been received.

Section 9 Right of withdrawal for consumers

9.1 Consumers (natural persons) have a statutory right of withdrawal.

9.2 Cancellation policy:

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us (Solomia Madalina Bednarsky, Hohenrainweg 22B, 77767 Appenweier, E-Mail: info@solomias.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail).

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

9.3 Consequences of revocation:

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the cheapest standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

9.4 Conditions for returns:

a) The product must be returned unused and in perfect condition. Inspection of the product as would be possible in a retail store is permitted. Any further signs of use, damage, or missing parts may result in a deduction from the refund amount.

b) The original product packaging (including dust bag, label, protective film, etc.) must not be damaged. The shipping packaging may be opened.

c) The product must be returned with all original labels and in the original packaging.

9.5 Faulty or damaged items:

Should an item be faulty or damaged, we will of course cover the costs of return shipping or exchange. Please contact us in advance by email at info@solomias.de to arrange the return.

§ 10 Warranty and Guarantee

10.1 The statutory warranty rights apply.

10.2 All products are covered by the manufacturer's warranty from Italy.

10.3 We inspect each product before shipping it to the customer. If a defect is found, we will contact the customer by email and arrange a solution (exchange or refund).

10.4 The manufacturer's warranty is only valid if the customer presents a proof of purchase (invoice) and has used the product in accordance with the care and usage instructions.

10.5 The warranty does not cover damage or defects arising from the following reasons:

a) Customer fault or improper care

b) Incorrect use of the product

c) Natural wear and tear from use

§ 11 Liability

11.1 We shall not be liable for delays or failure to perform our obligations caused by circumstances beyond our control, including but not limited to: weather conditions, transport delays, delays by the manufacturer in Italy, customs clearance, force majeure or other unforeseeable events.

11.2 We accept no liability for damages caused by incorrect or inaccurate information provided by the customer (delivery address, contact details).

§ 12 Dispute Resolution

12.1 All disputes between the customer and us should first be settled through negotiation. Complaints will be processed within 5 working days.

12.2 The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

12.3 If a dispute cannot be resolved amicably, the place of jurisdiction is Germany.

§ 13 Amendments to the General Terms and Conditions

We reserve the right to change these terms and conditions at any time. The terms and conditions valid at the time of ordering shall apply.

§ 14 Final Provisions

14.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

14.2 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
